The Safeguard American Voter Eligibility Act, also known as the SAVE Act, aims to ensure the security of the voter registration process in the United States. One provision includes verifying the voter’s citizenship status before allowing them to vote in a federal election. Verification would require documents such as a birth certificate, US passport, naturalization certificate, certificate of citizenship, or any official documentation proving US citizenship. States are mandated to establish processes to verify citizenship and remove non-citizens from voter rolls. Furthermore, the bill allows individuals to take legal action against election officials who allow non-citizens to register to vote. •      "The SAVE Act is entirely unnecessary and only serves to harm voters. There is no evidence of any pervasive or widespread voting by those who are ineligible to vote, including those who are not citizens. Existing federal law already prohibits voting in federal elections by noncitizens.1 Moreover, all individuals must already swear under penalty of law to their citizenship when registering to vote. This bill would erect significant additional barriers to voting and prevent eligible voters who do not have ready access to citizenship documents like birth certificates or passports - often due to logistical and financial barriers - from participating in our democracy. In fact, a recent study found that more than 21 million Americans lack easy access to proof-of-citizenship documents that this bill would require.2 When Kansas enacted a similar law over a decade ago, a federal court found it unconstitutional based on the severe burden it placed on qualified Kansans attempting to register – over 30,000 of whom, 12% of applicants, were unfairly denied the ability to register." •      "Republicans in Congress have introduced the extreme anti-voter Safeguard American Voter Eligibility (SAVE) Act (H.R. 22/S.128 and declared it among their top priorities. This bill would hinder millions of eligible Americans from registering to vote by requiring citizens to present a birth certificate or passport in person to register. Millions of Americans don’t have easy access to these documents. More than 21.3 million Americans lack immediate access to documentary proof of citizenship. More than 140 million Americans do not have a passport, and elderly Americans are one of the demographic groups least likely to have one. 69 million women who have taken their spouse’s last name do not have a birth certificate that matches their legal name. Similarly, transgender people who change their name to reflect their gender identity may be denied new passports and become ineligible to register. Disabled people are already much more likely to encounter a difficulty while voting compared to a nondisabled voter; more stringent requirements will just make this worse. Citizens of color are three times more likely than white citizens to lack documents such as birth certificates, passports, naturalization certificates, or certificates of citizenship. •      "We are calling on Congress to reject the Safeguard American Voter Eligibility (SAVE) Act, H.R. 22, which could go directly to a House floor vote this month as it is one of 12 bills identified for fast tracking. A companion bill, S.128, has also been filed in the Senate where it would likely need to overcome the filibuster. This bill, on its surface, requires proof of citizenship for registering to vote in any and all federal elections. However, the implementation of the law would have dramatic effects on our work and the communities we serve. While it is reasonable to prevent non-citizens from voting, existing law already does that. All federal voter registration forms include a checkbox requiring registrants to positively affirm citizenship. Violating that is punishable and instances of non-citizens voting is exceedingly rare. The issue with the SAVE Act is that the bill would require all voters to provide in person, documentary proof of citizenship – a passport or birth certificate (with a photo ID) in most cases – anytime they register or update their registration.
