Should Congress limit which biotechnology companies U.S. agencies can work with?

Awaiting Vote
Bill Summary

This bill prohibits executive government agencies from contracting with biotechnology providers of concern; these include BGI, MGI, Complete Genomics, Wuxi Apptec, and any of their subsidiaries. The bill also prohibits executive agencies from using loan or grant funds to enter into a contract with or purchase biotechnology equipment from providers of concern. The bill does allow for certain exceptions, such as in cases where the best interest of the national security of the United States lies in working with one of the outlined companies. In these cases, heads of executive agencies may apply for a waiver. Sponsor: Sen. Gary Peters (Democrat, Michigan)

Proponents say

•    "Yet our current tools are insufficient to protect this technology. The U.S. technological ecosystem is a bucket with massive holes in the bottom that we continue to pour billions and billions of R&D dollars into every year. We could plug the holes with export controls, enhanced investment screening, and outbound capital restrictions. But we choose not to. It's as though a burglar has robbed your home dozens of times before, told you that he’s coming back tonight, and you still leave your front door unlocked and your valuables lying around in plain sight. Who is harmed when the CCP steals American technology? It’s not the CEOs, it’s not the lobbyists. It’s our service members who are put in danger when the CCP weaponizes stolen technology. It’s our farmers. It’s ordinary Americans. Our country is filled with invisible factories and invisible farms— those that would have been built or planted here if we’d protected American technology. There are invisible paychecks — those that our workers and farmers would have gotten if we weren’t sending $600 billion to our foremost global adversary every year in stolen IP and trade secrets. Just like the farmer in the Iowa field, we are being robbed every day, in plain sight, by the Chinese Communist Party." Source: Rep. Mike Gallagher (Republican, Wisconsin, District 8)

•    "It is unacceptable for U.S. taxpayer dollars to be used to subsidize biotech companies of our foreign adversaries. By allowing these companies to amass and analyze large amounts of foreign genomic data, we risk our most sensitive information being used by our foreign adversaries against us. Our legislation addresses this problem by establishing a regulatory framework to prevent the flow of taxpayer dollars to biotech entities of concern. Closing this loophole is the first step in protecting the American bio-economy and our national security, and ensuring our genomic data is kept safe and secure." Source: Rep. Raja Krishnamoorthi (Democrat, Illinois, District 8)
